Q. - Is there a noise ordinance within
the city limits of Terrell? We have a major problem in our neighborhood.
Answer - Thanks for your inquiry.
The City of Terrell has Noise Ordinance, #2139. Generally, noise created
by persons or animals in excess of 85 decibels at a distance of 50 ft.
from the source’s property line is a violation, “particularly”
including loud music.
The police department has a decibel meter but they have to measure
the noise level at the time of the complaint. If a police officer is
able to get to the scene and record measurements above the limit, the
police officer may issue a citation without the testimony of a citizen.
However, in cases where there is no measurement available, a citizen
can make a complaint with Terrell PD, agree to appear in city court
and testify the noise “caused material distress, discomfort, or
injury to persons of ordinary sensibilities in the immediate vicinity.”
An officer can issue a citation to the responsible party for the noise
and the matter will be referred to Municipal Court.
The Terrell Police Department has received only 2 calls this year on
the street mentioned in this question. Both calls were received on the
same day back in August and involved a loud party.
While a property owner is free to enjoy the use of his property, his
property rights do not allow him to violate the law. Terrell PD makes
every effort to maintain safe, peaceful neighborhoods. If a citizen
has a noise problem in a neighborhood, the police should be called.
