REGULAR CITY COUNCIL MEETING FEBRUARY 18, 2003 7:00 P.M. A regular meeting of the Terrell City Council was held on Tuesday, February 4, 2003 in the City Council Chambers at 7:00 P.M. with the following members present: COUNCILMEMBER #1 FRANCES ANDERSON 1. Call to order. Mayor Frances Anderson called the meeting to order. 2. Invocation. Pastor Gary Weems gave the invocation. 3. Consider Approval of Regular City Council Meeting Minutes of February 4, 2003. Councilmember Floyd Trammell made a motion to approve the Regular City Council Meeting Minutes of February 4, 2003. The motion was seconded by Councilmember Rick Carmona. Ayes - all; Nayes - none. Motion carried. NEW BUSINESS 4. City Manager Gordon Pierce and Doug Hartman representing First Southwest Company presented to Council for discussion and consideration All Matters Incident and Related to the Issuance and Sale of $1,500,000 Tax and Airport Surplus Revenue Certificates of Obligation, Series 2003 Dated February 1, 2003 Including the Receipt of Bids Therefore. Councilmember Rick Carmona made a motion to accept the bid of Morgan Keegan & Company, Inc. for the purchase of $1,500,000 "City of Terrell, Texas, Tax and Airport Surplus Revenue Certificates of Obligation, Series 2003" at a true interest cost rate of 4.403288% and adopt the Ordinance authorizing the issuance of such certificates of obligation. The motion was seconded by Councilmember Floyd Trammell. Ayes - all; Nayes - none. Motion carried. b.) Discuss and Consider Adoption of Ordinance No. 2153 - Authorizing the Issuance of "$1,500,000 "City of Terrell, Texas Tax and Airport Surplus Revenue Certificates of Obligation, Series 2003"; Levying an Ad Valorem Tax Upon All Taxable Property in the City and Providing for a Pledge of the Net Revenues of the City's Airport for the Payment of Said Certificates; Prescribing the Terms and Details of Such Certificates and Resolving Other Matters Incident and Related to the Issuance, Sale, Security, Payment and Delivery of said Certificates, Including the Approval of a Paying Agent/Registrar Agreement and the Approval and Distribution of an Official Statement Pertaining Thereto; and Providing an Effective Date. Motion adopting Ordinance No. 2153 made in (a).
5. Discuss and Consider Approving the Renewal of a Mutual Cooperation Agreement Between City of Terrell Police Department and the Northeast Area Drug Task Regional Anti-Drug Abuse Task Force. Assistant Chief of Police Mike Shewmake and John Davila representing the Northeast Area Drug Interdiction Task Force Regional Anti-Drug Abuse Task Force presented to Council for discussion and consideration the Renewal of a Mutual Cooperation Agreement Between City of Terrell Police Department and the Northeast Area Drug Task Regional Anti-Drug Abuse Task Force. Councilmember Rick Carmona made a motion to approve the Renewal of a Mutual Cooperation Agreement Between City of Terrell Police Department and the Northeast Area Drug Task Regional Anti-Drug Abuse Task Force. The motion was seconded by Councilmember Debra Kelley. Ayes - all; Nayes - none. Motion carried. 6. Discuss and Consider Appointments to the Terrell Economic Development Corporation Board. Mayor Frances Anderson made a motion to appoint Douglas Howie, Jay Champion and re-appoint Ivan Johnson to the Terrell Economic Development Corporation Board. The motion was seconded by Mayor Pro tem Tommy Spencer. Ayes - Tommy Spencer, Frances Anderson. Nayes - Rick Carmona, Debra Kelley and Floyd Trammell. Councilmember Rick Carmona made a motion to re-appoint Ivan Johnson, re-appoint Dr. Scott Ervin and appoint Jay Champion to the Terrell Economic Development Corporation Board. The motion was seconded by Councilmember Debra Kelley. Ayes - Debra Kelley, Rick Carmona. Nayes - Tommy Spencer, Floyd Trammell and Frances Anderson. Councilmember Floyd Trammell made a motion to appoint Douglas Howie, Dr. Horace Flatt and re-appoint Dr. Scott Ervin to the Terrell Economic Development Corporation Board. Motion dies for lack of second. Mayor Frances Anderson made a motion to appoint Douglas Howie, Jay Champion and re-appoint Ivan Johnson to the Terrell Economic Development Corporation Board. The motion was seconded by Mayor Pro tem Tommy Spencer. Ayes - Tommy Spencer, Floyd Trammell, Frances Anderson. Nayes - Rick Carmona, Debra Kelley. Motion carried. 7. Discuss and Consider Approval of Ordinance No. 2156 - Amending Chapter 5, Business Regulations, Section 6, Peddlers, Solicitors and Vendors; Providing for Repeal of Conflicting Ordinances; Providing for Severability; and Providing an Effective Date. City Manager Gordon Pierce and Assistant City Attorney Greg Shumpert presented to Council for discussion and consideration Ordinance No. 2156 - Amending Chapter 5, Business Regulations, Section 6, Peddlers, Solicitors and Vendors; Providing for Repeal of Conflicting Ordinances; Providing for Severability and Providing an Effective Date. Councilmember Rick Carmona made a motion to table this item to the March 4, 2003 City Council Meeting. The motion was seconded by Councilmember Debra Kelley. Ayes - all; Nayes - none. Motion carried. 8. Discuss and Consider Approval of Ordinance No. 2157 - Amending Chapter 4, Building Regulations, Section 24, Exterior Construction Requirements and Standards of the City of Terrell Code of Ordinances; Providing for Repeal of Conflicting Ordinances; Providing for Severability; and Providing an Effective Date.

Discuss and Consider Approval of Ordinance No. 2158 - Amending Chapter 6: Fire Protection, Section 4: Fire Lanes, Paragraph C: Fire Lanes Required of the Revised Code of Ordinances of the City of Terrell; Providing for Repeal of Conflicting Ordinances; Providing for Severability and Providing an Effective Date. Roger Roach presented to Council for discussion and consideration Ordinance No. 2158 - Amending Chapter 6: Fire Protection, Section 4: Fire Lanes, Paragraph C: Fire Lanes Required of the Revised Code of Ordinances of the City of Terrell; Providing for Repeal of Conflicting Ordinances; Providing for Severability and Providing an Effective Date. Stan Ballard, City Engineer presented to Council for discussion and consideration Authorizing Carter & Burgess, Inc. to Provide Engineering Services for Improvements to the East Nash Drainage Channel. Councilmember Rick Carmona made a motion to approve authorizing Carter & Burgess, Inc. to Provide Engineering Services for improvements to the East Nash Drainage Channel in an amount not to exceed $38,000.00. The motion was seconded by Councilmember Debra Kelley. Ayes - all; Nayes - none. Motion carried. 12. Consider Granting an Easement to Oncor Electric Delivery Company for Facilities on the Municipal Airport. Stan Ballard, City Engineer presented to Council for discussion and consideration Granting an Easement to Oncor Electric Delivery Company for Facilities on the Municipal Airport. Councilmember Debra Kelley made a motion to approve granting an easement to Oncor Electric Delivery Company for Facilities on the Municipal Airport. The motion was seconded by Councilmember Rick Carmona. Ayes - all; Nayes - none. Motion carried. 13. Discuss and Consider Amendment to Fleet Maintenance Budget. City Manager Gordon Pierce and Steve Rogers, Director of Public Works presented to Council for discussion and consideration Amendment to Fleet Maintenance Budget. Councilmember Rick Carmona made a motion to approve Amendment to Fleet Maintenance Budget by purchasing the mower budgeted as well as three additional mowers in lieu of the tractor that was budgeted for $35,000.00. The motion was seconded by Councilmember Debra Kelley. Ayes - all; Nayes - none. Motion carried. 14. Discuss Equipment Purchasing Policies. City Manager Gordon Pierce and Steve Rogers, Director of Public Works presented to Council for discussion Equipment Purchasing Policies. Council by consensus agreed to go ahead with the purchase of squad cars and one pick-up and report back to Council the cost. 15. Discuss and Consider Approval of Ordinance No. 2154 - Amending Chapter 9, Section 9-9; Civil Service Classification Plan (a) Classification of Fire Fighters and (b) Classification of Police Officers (1) Positions Appointed by the Chief of Police and Fire Chief (2) Police Officer Classification of the Revised Code of Ordinances of the City of Terrell. Carol Holland, Director of Human Resources presented to Council for discussion and consideration Ordinance No. 2154 - Amending Chapter 9, Section 9-9; Civil Service Classification Plan (a) Classification of Fire Fighters and (b) Classification of Police Officers (1) Positions Appointed by the Chief of Police and Fire Chief (2) Police Officer Classification of the Revised Code of Ordinances of the City of Terrell. CIVIL SERVICE CLASSIFICATION PLAN; (a) CLASSIFICATION OF FIRE FIGHTERS AND (b) CLASSIFICATION OF POLICE OFFICERS, (1) POSITIONS APPOINTED BY THE CHIEF OF POLICE AND FIRE CHIEF; (2) POLICE OFFICER CLASSIFICATION; OF THE REVISED CODE OF ORDINANCES OF THE CITY OF TERRELL, TEXAS; PROVIDING FOR REPEAL OF CONFLICTING ORDINANCES; PROVIDING FOR SEVERABILITY AND PROVIDING AN EFFECTIVE DATE. 16. Hear Remarks from Visitors. Minnie Presley, 701 West End Street, came before Council to discuss equality of service. As a point of order, Ms. Presley was directed not to use employee names. Elizabeth Trammell came before Council to discuss Board appointments. OLD BUSINESS 17. Receive City Manager's Reports and Correspondence - Discuss February 20-21, 2003 Retreat Schedule. City Manager Gordon Pierce presented Manager's reports and correspondence to Council. 18. Adjourn. There were no other matters discussed or acted on at this meeting.
