REGULAR CITY COUNCIL MEETING

APRIL 1, 2003

A regular meeting of the Terrell City Council was held on Tuesday, April 1, 2003 in the City Council Chambers at 7:00 P.M. with the following members present:

1. Call to order.

Mayor Frances Anderson called the meeting to order.

2. Invocation.

Reverend Joe Ed Goolsby gave the opening prayer.

3. Consider Approval of Regular City Council Meeting Minutes of March 18, 2003.

Councilmember Floyd Trammell made a motion to approve the Regular City Council Meeting Minutes of March 18, 2003 with a correction to Item No. 11. The motion was seconded by Councilmember Rick Carmona. Ayes - all; Nayes - none. Motion carried.

11. Discuss and Consider Approval of Ordinance No. 2167 - Amending Chapter 4: Building Regulations, Section 4-1: Appointment and Removal of Chief Building Official.

Carol Holland, Personnel Director presented to Council for discussion and consideration Ordinance No. 2167 - Amending Chapter 4: Building Regulations, Section 4-1: Appointment and Removal of Chief Building Official. Councilmember Floyd Trammell made a motion to adopt Ordinance No. 2167 - Amending Chapter 4: Building Regulations, Section 4-1: Appointment and Removal of Chief Building Official. The motion was seconded by Mayor Pro tem Tommy Spencer. Ayes - all; Nayes - none. Motion carried.

4. Receive and Consider Financial Audit Report for Fiscal Year 2001-2002.

Mayor Frances Anderson recognized April Dungan for attending the meeting from Trinity Valley Community College.

Frank Hinton representing Wagner, Eubank & Nichols presented to Council for consideration the Financial Audit Report for Fiscal Year 2001-2002. Councilmember Rick Carmona made a motion to table the Financial Audit Report for Fiscal Year 2001-2002 to the April 15, 2003 Council Meeting. The motion was seconded by Councilmember Floyd Trammell. Ayes - all; Nayes - none. Motion carried.

5. Discuss and Consider Planning and Zoning Recommendation for Preliminary Plat of Lost Creek Estates/ P. Walker Survey (A-569).

City Manager Gordon Pierce and Stan Ballard, City Engineer presented to Council for discussion and consideration Planning and Zoning Recommendation for Preliminary Plat of Lost Creek Estates/ P. Walker Survey (A-569).Councilmember Floyd Trammell made a motion to adopt the Planning and Zoning Recommendation for Preliminary Plat of Lost Creek Estates / P. Walker Survey (A-569) with variances to the Subdivision Ordinance regarding cul-de-sacs, alleyways, alternate paving, sidewalks, curb and gutters as well as requesting the developer/project engineer to address the street names. The motion was seconded by Mayor Pro tem Tommy Spencer. Ayes - all; Nayes - none. Motion carried.

6. Discuss and Consider Adoption of Parks, Recreation and Open Space Master Plan.

City Manager Gordon Pierce, Steve Rogers, Director of Public Works and Dennis Sims representing Dunkin, Sims, Stoffels, Inc. presented to Council for discussion and consideration Parks, Recreation and Open Space Master Plan. Councilmember Rick Carmona made a motion to adopt the Parks, Recreation and Open Space Master Plan. The motion was seconded by Councilmember Debra Kelley. Ayes - all; Nayes - none. Motion carried.

7. Discuss and Consider Street Closings Request from the Terrell Downtown Association.

Elise K. Long, President of the Terrell Downtown Association presented to Council for discussion and consideration Street Closings Request from the Terrell Downtown Association on May 24, 2003, October 31, 2003 and December 13, 2003. Councilmember Floyd Trammell made a motion to grant the request of the Terrell Downtown Association for street closings. The motion was seconded by Councilmember Rick Carmona. Ayes - all; Nayes - none. Motion carried.

8. Discuss and Consider Approval of Resolution No. 450 - Amending the City of Terrell Employee Handbook.

Carol Holland, Director of Personnel presented to Council for discussion and consideration Resolution No. 450 - Amending the City of Terrell Employee Handbook. Councilmember Debra Kelley made a motion to approve Resolution No. 450 - Amending the City of Terrell Employee Handbook. The motion was seconded by Councilmember Rick Carmona. Ayes - all; Nayes - none. Motion carried.

RESOLUTION NO. 450

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TERRELL, TEXAS ADOPTING AMENDMENTS TO THE CITY OF TERRELL EMPLOYEE HANDBOOK.


WHEREAS, the City of Terrell has the authority to adopt rules and regulations for the orderly handling of the personnel employed by said city; and

WHEREAS, this resolution is not to be construed as a contractual agreement between employer and employees, but is intended as a statement of policies to be followed by the City of Terrell in its relations with its employees; and

WHEREAS, the City Council of the City of Terrell is of the opinion that it will be to the best interest of the city to amend the City of Terrell Employment Handbook.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF TERRELL COUNCIL OF THE CITY OF TERRELL, TEXAS:

THAT, the Employee Handbook, of the City of Terrell, as heretofore prepared, be hereby in all things approved and adopted as the amendments for the employees of the City of Terrell, and all of the personnel, excepting those employees covered by Local Government Code, Chapter 143, of the City of Terrell shall be so governed thereby; provided, however that the City council of the City of Terrell shall from time to time have the right to make amendments to said policy, no person or employee of the City shall have any vested contractual rights under such handbook, and all privileges, not spelled out in this document shall be deemed to belong to the City of Terrell.

9. Discuss and Consider Approval of Resolution No. 451 - Authorizing and Approving an Application for Funding through the Federal Emergency Management Agency - Assistance to Firefighters Grant Program.

Raylan Baker, Administrative Assistant presented to Council for discussion and consideration Resolution No. 451 - Authorizing and Approving an Application for Funding through the Federal Emergency Management Agency - Assistance to Firefighters Grant Program. Mayor Pro tem Tommy Spencer made a motion to approve Resolution No. 451 - Authorizing and Approving an Application for Funding through the Federal Emergency Management Agency - Assistance to Firefighters Grant Program. RESOLUTION NO. 451


A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TERRELL AUTHORIZING AND APPROVING AN APPLICATION FOR FUNDING THROUGH THE FEDERAL EMERGENCY MANAGEMENT AGENCY - ASSISTANCE TO FIREFIGHTERS GRANT PROGRAM.

BE IT RESOLVED by the city Council of the City of Terrell, Texas, as follows:

WHEREAS, the City Council concurs with the purpose of the 2003 Assistance to Firefighters Grant Program to award one-year grants directly to fire departments of the State to enhance their abilities with respect to fire and fire-related hazards, and further understands this program seeks to support departments that lack the tools and resources necessary to protect the health and safety of the public and their firefighting personnel with respect to fire and fire related hazards, with a primary goal to provide assistance to meet fire departments' firefighting needs; and

WHEREAS, the City Council has reviewed and hereby approves an application for grant funds through the Federal Emergency Management Agency and recognizes the need to match the Federal grant funds with an amount of non-Federal funds equal to 10 percent (10%) of the total project costs; and

WHEREAS, the city Council has received and agrees to comply with all assurances executed in connection with the application, and if awarded, the grant.

PASSED AND APPROVED at the meeting of the City Council of the city of Terrell, Texas on the 1st day of April, 2003.

10. Discuss and Consider Appointments to the Civil Service Commission.

City Manager Gordon Pierce presented to Council for discussion and consideration Appointments to the Civil Service Commission. Councilmember Rick Carmona made a motion to re-appoint John Davidson and Oscar Hinchen to the Civil Service Commission. The motion was seconded by Mayor Pro tem Tommy Spencer. Ayes - Rick Carmona, Tommy Spencer, Debra Kelley, Frances Anderson. Nayes - Floyd Trammell. Motion carried.

11. Discuss and Consider Appointments to the Terrell Public Library Board.

City Manager Gordon Pierce presented to Council for discussion and consideration Appointments to the Terrell Public Library Board. Councilmember Debra Kelley made a motion to appoint James Crouch to the Terrell Public Library Board. The motion was seconded by Councilmember Rick Carmona. Ayes - all; Nayes - none. Motion carried.

Mayor Pro tem Tommy Spencer made a motion to re-appoint Jim Warlick to the Terrell Public Library Board. The motion was seconded by Councilmember Rick Carmona. Ayes - all; Nayes - none. Motion carried.

Councilmember Floyd Trammell made a motion to re-appoint John Hoffmeyer and David Capers to the Terrell Public Library Board. The motion was seconded by Mayor Pro tem Tommy Spencer. Ayes - all; Nayes - none. Motion carried.

12. Discuss and Consider Approval of Ordinance No. 2168 - Providing for the Registration of Retail Electric Providers, Requiring Local Registration of Retail Electric Providers Pursuant to Section 39.358 of the Texas Utilities Code, Providing for a Registration Fee; Providing for the Suspension or Revocation of Registration for Significant Violations of Chapter 39 of the Texas Utilities Code; and Providing for an Effective Date.

City Manager Gordon Pierce and Assistant City Manager Torry L. Edwards presented to Council for discussion and consideration Ordinance No. 2168 - Providing for the Registration of Retail Electric Providers, Requiring Local Registration of Retail Electric Providers Pursuant to Section 39.358 of the Texas Utilities Code, Providing for a Registration Fee; Providing for the Suspension or Revocation of Registration for Significant Violations of Chapter 39 of the Texas Utilities Code; and Providing for an Effective Date. 13. Discuss Traffic Calming Devices.

City Manager Gordon Pierce and Steve Rogers, Director of Public Works presented to Council for discussion Traffic Calming Devices. Council by consensus agreed bring back options other than humps or bumps.

14. Discuss Requirements and Procedures for Installation of Traffic Control Devices.

City Manager Gordon Pierce and Stan Ballard, City Engineer presented to Council for discussion and consideration Requirements and Procedures for Installation of Traffic Control Devices. There was no action taken on this item.

15. Discuss and Consider Approval of Resolution No. 452 - Development Regulations.

City Manager Gordon Pierce presented to Council for discussion and consideration Resolution No. 452 - Development Regulations. Councilmember Rick Carmona made a motion to approve Resolution No. 452 - Development Regulations. The motion was seconded by Mayor Pro tem Tommy Spencer. Ayes - all; Nayes - none. Motion carried.

16. Hear Remarks from Visitors.

Colin Fairley - 1007 N. Frances spoke to Council regarding increased traffic volume and speed on North Frances and exprees his support for speed humps and bumps.

Paul Smith - 7217 N. State Highway 34 spoke to Council regarding his petition for school uniforms.

17. Discuss and Consider Adoption on Second Reading Ordinance No. 2162 - Budget Amendment.

ORDINANCE NO. 2162

AN ORDINANCE OF THE CITY OF TERRELL, TEXAS, AMENDING THE ANNUAL BUDGET FOR THE YEAR BEGINNING OCTOBER 1, 2002, AND ENDING SEPTEMBER 30, 2003, AS PASSED AND ADOPTED ON SEPTEMBER 17, 2002 TO PROVIDE FOR INCREASES AND DECREASES IN CERTAIN ACCOUNTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TERRELL, TEXAS:

SECTION I.

The General Fund is amended to reflect the following increases in the budget:

It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this Ordinance are severable and, if any phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionally shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this Ordinance, since the same would have been enacted by the city council without the incorporation of this Ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section.

SECTION IV.

This Ordinance will take effect immediately from and after its passage and the publication of the caption, as the law in such cases provides.

18. Discuss and Consider Adoption on Second Reading Ordinance No. 2165 - Establishing Traffic Controls at the Intersection of Roosevelt with Rockwall.

AN ORDINANCE OF THE CITY OF TERRELL, TEXAS AUTHORIZING THE INSTALLATION AND MAINTENANCE OF A STOP SIGN AT THE SOUTHWEST CORNER OF THE INTERSECTION OF ROOSEVELT AND SOUTH ROCKWALL AVENUE; PROVIDING FOR ENFORCEMENT; PROVIDING FOR THE REPEAL OF CONFLICTING ORDINANCES; PROVIDING FOR PUBLICATION OF CAPTION; AND ESTABLISHING AN EFFECTIVE DATE.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TERRELL, TEXAS:

ARTICLE I.

THAT there be installed at the southwest corner of the intersection of Roosevelt Street and South Rockwall Avenue appropriate signs, in accordance with Chapter 11, Section 36, of the City of Terrell, 1986 Revised Code of Ordinances notifying drivers of vehicles approaching such intersection, traveling east bound on Roosevelt Street, to come to a full stop. Drivers or operators of vehicles approaching such sign shall comply with the requirements of Chapter 11, Section 36, with regards thereto.

ARTICLE II.

All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict, hereby repealed.

ARTICLE III.

This ordinance will take effect immediately from and after its passage and the publication of the caption as the law in such cases provides.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TERRELL, TEXAS, AMENDING CHAPTER 9, SECTION 9-2 DEPARTMENTS OF THE REVISED CODE OF ORDINANCES OF THE CITY OF TERRELL, TEXAS; PROVIDING FOR REPEAL OF CONFLICTING ORDINANCES; PROVIDING FOR SEVERABILITY AND PROVIDING AN EFFECTIVE DATE.


BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TERRELL, TEXAS:

ARTICLE I.

THAT, Chapter 9, Section 9-2. Department heads of the revised code of ordinance of the City of Terrell, Texas, be and is hereby amended to add Subsection (12) as follows:

(12) Municipal Development Director. There is hereby created the office of Municipal Development Director who shall be appointed and removed by the City Manager upon confirmation and approval of the City Council.

The Municipal Development Director shall be responsible for all compliance with rules and regulations relating to comprehensive planning for the City of Terrell, Texas.

ARTICLE II.

All ordinances or parts of ordinances in conflict herewith are, to the extent of such conflict, is hereby repealed.

ARTICLE III.

It is hereby declared to be intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable and, if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TERRELL, TEXAS:

SECTION I.

That, Chapter 4: Building Regulations, Section 4-1: Chief Building Official, Subsection (b) Appointment and removal, be amended to read as follows:

Sec. 4-1 Chief Building Official
(b) Appointment and Removal. The building official shall be appointed by the Municipal Development Director and removed in accordance with applicable personnel policies and procedures.


SECTION II.

All ordinances or parts of ordinances in conflict herewith are, to the extent of such conflict, is hereby repealed.

SECTION III.
