CITY COUNCIL MEETING

FEBRUARY 18, 1997

1.0 ANNOUNCEMENTS & PUBLIC HEARINGS

A regular meeting of the City Council was held February 18, 1997, at 7:00 p.m. with the following members present:

1.1 INVOCATION

In the absence of Mayor Don L. Lindsey, the meeting was called to order by Mayor ProTem Robert Messer and Councilmember Frances Anderson gave the opening prayer.

1.2 PRESENTATION OF ARLIE WHITE P.R.I.D.E. AWARD

Award winner not present.

2.0 MINUTES

2.1 CONSIDER APPROVAL OF CITY COUNCIL MINUTES OF THE SPECIAL MEETING HELD JANUARY 30, 1997, AND THE REGULAR MEETING HELD FEBRUARY 4, 1997.

A motion was made by Councilmember Frances Anderson and seconded by Councilmember Jack Jones to approves minutes of January 30, 1997, and February 4, 1997. Ayes all; Nayes none. Motion carried.

3.0 BIDS

3.1 CONSIDER BIDS AND AWARD OF CONTRACT FOR FUEL

A motion was made by Councilmember Jack Jones and seconded by Councilmember Tommy Spencer to award contract to Truman - Arnold Co., the low bidder, as recommended by staff. Ayes all; Nayes none. Motion carried.

3.2 CONSIDER BIDS AND AWARD OF CONTRACT FOR AUTOMATED CITIZENS INFORMATION SYSTEM

A motion was made by Councilmember Jack Jones and seconded by Councilmember Frances Anderson to approve the bid from the one bidder - Tele-works, Inc. For $15,950.00 Ayes all; Nayes none. Motion carried.

3.3 CONSIDER BIDS AND AWARD OF CONTRACT FOR HOUSING - DEMOLITION

A motion was made by Councilmember Jack Jones and seconded by Councilmember Frances Anderson to accept the following bids for demolition of structures:

1004 S. Catherine no action
721 Mineral Wells Dad & Son - $1,300.00
715 Mineral Wells Nabors Wrecking Co., Inc. - $1,200.00
300 Bradshaw Cunnie Wofford - $2,400.00


Ayes: Jack Jones, Frances Anderson, Robert Messer; Nayes none. Tommy Spencer abstained from voting due to conflict of interest. Motion carried.

3.4 CONSIDER BIDS AND AWARD OF CONTRACT FOR TANDEM - AXLE DUMP TRUCK

A motion was made by Councilmember Jack Jones and seconded by Councilmember Frances Anderson to accept the low bid for financing the Tandem-Axle Dump Truck to ANB Leasing, Inc. for $44,280.97 with annual payments of $8,856.19. Ayes Jack Jones, Frances Anderson, Tommy Spencer; Nayes none. Robert Messer abstained from voting due to being employed by American National Bank. Motion carried.

4.0 ROUTINE BUSINESS

5.0 OLD BUSINESS

5.1 CONSIDER ADOPTION OF ORDINANCE #1867 - SPECIFIC USE PERMIT

A motion was made by Councilmember Jack Jones and seconded by Councilmember Frances Anderson to deny on second reading Ordinance No. 1867. Ayes all; Nayes none. Motion carried.

6.0 NEW BUSINESS

6.1 CONSIDER APPROVAL OF FINAL REPLAT - ORIGINAL TOWN, BLOCK 44, LOTS 1 & 2

A motion was made by Councilmember Jack Jones and seconded by Councilmember Tommy Spencer to approve the Final Replat of Original Town, Block 44, Lots 1&2. Ayes all; Nayes none. Motion carried.

6.2 CONSIDER RESALE OF PROPERTY LEGALLY DESCRIBED AS PHAGAN, LOTS 47-48, BLOCK 4

A motion was made by Councilmember Frances Anderson and seconded by Councilmember Tommy Spencer to approve the resale of property legally described as Phagan, Lots 47-48, Block 4. Ayes all; Nayes none. Motion carried.

6.3 CONSIDER RESALE OF PROPERTY LEGALLY DESCRIBED AS NELSON, LOT 1, BLOCK 3

A motion was made by Councilmember Jack Jones and seconded by Councilmember Frances Anderson to accept the bid of $6,000.00 for the resale of the property legally described as Nelson, Lot 1, Block 3. Ayes all; Nayes none. Motion carried.

6.4 CONSIDER ADOPTION OF RESOLUTION NO. 300 - SUPPORTING SOLID WASTE MANAGEMENT DISTRICT

A motion was made by Councilmember Frances Anderson and seconded by Councilmember Tommy Spencer to table this item for further discussion and clarification. Ayes all; Nayes none. Motion carried.

CITY OF TERRELL
RESOLUTION #300

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TERRELL, TEXAS, TO JOIN WITH KAUFMAN COUNTY IN SUPPORT OF THE FORMATION OF A SOLID WASTE MANAGEMENT DISTRICT.

6.5 CONSIDER APPROVAL OF SURPLUS DPW EQUIPMENT FOR AUCTION/SALE

A motion was made by Councilmember Frances Anderson and seconded by Councilmember Jack Jones to approve the sale of the following Surplus DPW Equipment. Ayes all; Nayes none. Motion carried.

6.6 CONSIDER ADOPTION OF RESOLUTION #301 - DRIVEWAY AT I20 @ S.H. 34 AT TANGER

A motion was made by Councilmember Frances Anderson and seconded by Councilmember Tommy Spencer to approve Resolution No. 301 opposing the construction of a Private Driveway at I20 @ S.H. 34 at Tanger. Ayes all; Nayes none. Motion carried.

RESOLUTION NO. 301

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TERRELL TEXAS OPPOSING THE CONSTRUCTION OF A PRIVATE DRIVE CONNECTING PROPERTIES IN THE TANGER AND ECOL ADDITIONS AND PROVIDING ACCESS THEREBY TO STATE HIGHWAY NO. 34

WHEREAS, it has come to the attention of this council that the adjacent property owners have agreed to construct a private drive that would provide for vehicular access between the Tanger Addition and the ECOL Addition; and

WHEREAS, the proposed private drive will allow motor vehicles to traverse from Tanger Drive, across the ECOL Addition, to access State Hwy. No. 34; and

WHEREAS, an increase in traffic accessing State Hwy. No. 34 immediately south of Interstate Hwy. No. 20, and in the vicinity of several existing businesses, will result in an increased traffic hazard; and

WHEREAS, from a traffic safety point of view, all access to the highway from the Tanger Outlet Center facilities should be by way of the intersection of Tanger Drive with State Hwy. No. 34, which is provided with traffic signal controls;

NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TERRELL, TEXAS:

THAT this body is opposed to the construction of a private drive which will provide for vehicular access from Tanger Drive to State Hwy. No. 34 near that highway's intersection with Interstate Hwy. No. 20.

PASSED AND APPROVED this the 18th day of February, 1997.
