REGULAR CITY COUNCIL MEETING FEBRUARY 20, 2001 5:30 P.M.
COUNCILMEMBER #1 HENRY C. MADGWICK 1. CALL TO ORDER Mayor Henry C. Madgwick called the meeting to order. 2. INVOCATION Chuck Schorlemmer gave the opening prayer. 3. PRESENTATION FROM MAYOR MADGWICK TO KAUFMAN COUNTY SOLID WASTE MANAGEMENT COOPERATIVE, INC. Mayor Henry Madgwick presented a proclamation to Charlotte Gilmore representing Kaufman County Solid Waste Management Cooperative, Inc. 4. ARLIE WHITE P.R.I.D.E. EMPLOYEE AWARD PRESENTATION No action taken. 5. CONSIDER APPROVAL OF CITY COUNCIL REGULAR MEETING MINUTES OF JANUARY 16, 2001 AND FEBRUARY 6, 2001 Councilmember Frances Anderson made a motion to approve the City Council Regular Meeting Minutes of January 16, 2001 and February 6, 2001 with corrections to the January 16, 2001 Meeting Minutes. The motion was seconded by Councilmember James Huffman. Ayes - all; Nayes - none. Motion carried. January 16, 2001 City Manager Gordon Pierce and Municipal Development Director Will Cole presented to Council for discussion and consideration Exception to Ordinance No. 1976 - Exterior Elevation Requirements on Property Described as Lot 10, Block 1, Howard Addition. Councilmember James Huffman made a motion to follow the recommendation of the Planning and Zoning Commission to approve the request for Exception to Ordinance No. 1976 - Exterior Elevation Requirements on Property Described as Lot 10, Block 1, Howard Addition. The motion was seconded by Mayor Henry C. Madgwick. Councilmember Lee Schaeffer called for further discussion on the matter to be clear on whether a person down the street from this location was required to brick it even though it was behind a metal building; if it was an add-on to what he had and it was blocked off by a fence. He doubted that this property is blocked off by a fence. What was a small metal building is now a larger metal building and is covered by the ordinance. Councilmember Frances Anderson wanted to know where is the Council going to stop or begin. Ayes - James Huffman, Henry Madgwick. Nayes - Lee Schaeffer, Frances Anderson, Tommy Spencer. Motion denied. NEW BUSINESS a) CONDUCT A HEARING TO RECEIVE PUBLIC COMMENT ON THE PROPOSED THOROUGHFARE PLAN Mayor Henry Madgwick opened a hearing to Receive Public Comment on the Proposed Thoroughfare Plan. Dan Sefko Presented the opening comments to the council. James Mayes spoke for the Thoroughfare Plan. Earl Bradshaw, Roy Perkins, Lance Holmes and Minnie Presley asked questions regarding the Thoroughfare Plan. Henry Holmes spoke against the Thoroughfare Plan. Mayor Madgwick closed the hearing.
b) DISCUSS AND CONSIDER APPROVAL OF ORDINANCE NO. 2054 - ADOPTING THE PROPOSED THOROUGHFARE PLAN Councilmember James Huffman made a motion to Approve Ordinance No. 2054 - Adopting the Proposed Thoroughfare Plan, with instructions given to Mr. Sefko to block out the City of Oak Ridge. The motion was seconded by Mayor Pro tem Lee Schaeffer. Ayes - all; Nayes - none. Motion carried. Councilmember James Huffman commented that this is a working plan. It can be changed half a dozen times if we need to. We are hindering the Planning & Zoning Commission when a developer comes in here and applies or presents a new plat and we don't have a thoroughfare plan. If we want to provide for long range planning through that development where the streets need to go this serves as a guide line and gives Planning & Zoning an idea what to expect out of that developer and the developer knows what he has got to put into that plan. This thorough plan gives us a starting point to work off of. Councilmember Huffman also proposed two changes. On the spur 557 at the bridge show a future interchange and on U.S. 80 at FM 429 show a future interchange. ORDINANCE NO. 2054 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TERRELL, TEXAS, ADOPTING A THOROUGHFARE PLAN; PROVIDING FOR SEVERABILITY, AND PROVIDING AN EFFECTIVE DATE.
City Manager Gordon Pierce and Laura Wolfe representing the Terrell Tourism Board presented to Council for discussion and consideration Allocation of Reserve Tourism Funds to Assist in Terrell's Fifth Anniversary Benefit Car Show in the amount of $5,000.00. Mayor Pro tem Lee Schaeffer asked if the Tourism Board voted on the issue and was informed the Board recommendation was for the allocation of reserve funds. Mayor Pro tem Lee Schaeffer made a motion to approve the Allocation of Reserve Tourism Funds to Assist in Terrell's Fifth Anniversary Benefit Car Show in the amount of $5,000. The motion was seconded by Councilmember James Huffman. Ayes - All Nayes - None. 8. DISCUSS AND CONSIDER A REQUEST FOR EXCEPTION TO ORDINANCE NO. 1976 - EXTERIOR ELEVATION REQUIREMENTS, ON PROPERTY DESCRIBED AS LOT 10, BLOCK 1, HOWARD ADDITION City Manager Gordon Pierce and Fred Green presented to Council for discussion and consideration a Request for Exception to Ordinance No. 1976 - Exterior Elevation Requirements, on Property Described as Lot 10, Block 1, Howard Addition. Councilmember James Huffman made a motion to approve in accordance the Planning and Zoning recommendation the Request for Exception to Ordinance No. 1976 - Exterior Elevation Requirements, on Property described as Lot 10, Block 1, Howard Addition. The motion was seconded by Councilmember Tommy Spencer. Ayes - all; Nayes - none. Motion carried.
9. DISCUSS AND CONSIDER A REQUEST FOR EXCEPTION TO ORDINANCE NO. 1976 - EXTERIOR ELEVATION REQUIREMENTS, ON PROPERTY DESCRIBED AS LOT 1, BLOCK 441, TERRELL REVISED City Manager Gordon Pierce, Municipal Development Director Will Cole and W.T. Wilson presented to Council for discussion and consideration a Request for Exception to Ordinance No. 1976 - Exterior Elevation Requirements, on Property Described as Lot 1, Block 441, Terrell Revised. Councilmember Frances Anderson made a motion to approve Request for Exception to Ordinance No. 1976 - Exterior Elevation Requirement, on Property Described as Lot 1, Block 441, Terrell Revised contingent upon the entire front be wainscoted. The motion was seconded by Councilmember James Huffman. Ayes - all; Nayes - none. Motion carried.
10. DISCUSS AND CONSIDER CHANGE ORDER #2 AND ELECTRICAL REPAIRS FOR PROJECT 99-15 - REPAIR AND REPLACEMENT OF POOL PIPING AT BEN GILL PARK Steve Rogers, Public Works Director, presented to Council for discussion and consideration Change Order #2 and Electrical Repairs for Project 99-15 - Repair and Replacement of Pool Piping at Ben Gill Park. Mayor Pro tem Lee Schaeffer made a motion to approve Change Order #2 in the amount of $8,140 and electrical repairs in the amount of $4,800.00 for a total of $12,940. The motion was seconded by Councilmember Tommy Spencer. Ayes - all; Nayes - none. Motion carried.
11. DISCUSS AND CONSIDER APPROVAL OF ORDINANCE NO. 2053 - CALLING THE REGULAR MUNICIPAL ELECTION ON MAY 5, 2001 City Manager Gordon Pierce presented to Council for discussion and consideration Ordinance No. 2053 - Calling the Regular Municipal Election on May 5, 2001. Mayor Pro tem Lee Schaeffer made a motion to approve Ordinance No. 2053 - Calling the Regular Municipal Election on May 5, 2001. The motion was seconded by Councilmember Tommy Spencer. Ayes - all; Nayes -none. Motion carried. ORDINANCE NO. 2053 AN ORDINANCE OF THE CITY OF TERRELL, TEXAS, CALLING THE REGULAR MUNICIPAL ELECTION FOR THE CITY OF TERRELL, TEXAS FOR THE ELECTION OF COUNCILMEMBER FROM DISTRICT NO. 3 AND DISTRICT NO. 5 TO BE HELD ON SATURDAY, MAY 5, 2001.
City Manager Gordon Pierce presented to Council for discussion and consideration Appointments to the Terrell Public Library Board. Councilmember James Huffman made a motion to re-appoint Riter Hulsey, Barbara Willie and Jim McGinty to the Terrell Public Library Board. The motion was seconded by Councilmember Frances Anderson. Ayes - all; Nayes - none. Motion carried.
13. DISCUSS AND CONSIDER CUSTOMER SERVICE STRATEGY POLICY AND PROCEDURE City Manager Gordon Pierce presented to Council for discussion and consideration Customer Service Strategy Policy and Procedure. Councilmember James Huffman commended City Manager Gordon Pierce on his efforts and with customer service. Councilmember James Huffman made a motion to concur and approve the Customer Service Strategy Policy and Procedure. The motion was seconded by Mayor Pro tem Lee Schaeffer. Ayes - all; Nayes - none. Motion carried.
14. DISCUSS CREATION OF CHARTER REVIEW COMMITTEE City Manager Gordon Pierce presented to Council for discussion and consideration Creation of Charter Review Committee. After debate by council Mr. Pierce recommended the Council place the matter on the March retreat agenda. There was no action taken on this item.
15. HEAR REMARKS FROM VISITORS Mrs. Ben Mikus came before Council and thanked Councilmember James Huffman and Mayor Henry Madgwick for suggesting that member of her committee be included in the steering committee for the management study for the police department. OLD BUSINESS Councilmember James Huffman made a motion to approve Ordinance No. 2046, Ordinance No. 2044, Ordinance No. 2052, Ordinance No. 2050, and Ordinance No. 2051 by Consent Agenda. The motion was seconded by Councilmember Frances Anderson. Ayes - all; Nayes - none. Motion carried. 16. SECTION 7. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TERRELL, TEXAS: THAT Appendix I, Fee Schedule, SECTION 7, BUILDING PERMIT FEES AND CHARGES, Subsection 1 thru 12 of the Revised Code of Ordinances of the City of Terrell, Texas, shall be deleted in its entirety and read as follows:
On all buildings, structures. or alterations requiring a building permit, a fee for such building permit shall be paid as required at the time of issue, in accordance with the following schedule: (1) Schedule Of Permit Fees Standard Building code- Appendix B Section B101 Permit Fees Total Valuation Fee $1,000 and less No fee, unless inspection required, in which case a $15.00 fee for each inspection shall be charged $1,000 to $50,000 $15.00 for the first $1,000.00 plus $5.00 for
each $50,000 to $100,000 $260.00 for the first $50,000.00 plus $4.00
for each $100,000 to $500,000 $460.00 for the first $100,000.00 plus $3.00
for each additional $500,000 and up $1,660.00 for the first $500,000.00 plus $2.00
for each Section B102 Moving Fee For the moving of any building or structure, the fee shall be $100.00 Section B103 Demolition Fee For the demolition of any building or structure, the fee shall be: 0 up to 100,000 cu ft $50.00 Ordinance No. 2046 Section B104 Penalties Where work for which a permit is required by this code is started or proceeded prior to obtaining said permit, the fees herein specified shall be doubled, but the payment of such double fee shall not relive from fully complying with the requirements of this code in the execution of the work nor from any penalties prescribed herein. (1) Fee For Appeals Any person appealing a decision of the mechanical official shall pay a fee of fifty dollars ($50.00) to the City at the time such appeal is filed.

Single Family Phase Service 50 or less $11.00 0-225amp $11.00 Appliance, Machines, Equipment Motor, ect 10 or less $11.00 26-30 $33.00 Miscellaneous Electrical Fees Sign / Billboards $22.00
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TERRELL, TEXAS: THAT Appendix I, Fee Schedule, SECTION 9, PLUMBING PERMIT FEES AND CHARGES: SUBSECTION 1 THRU 6, of the Revised Code of Ordinances of the City of Terrell, Texas, shall be deleted in its entirety and read as follows: SECTION 9: PLUMBING PERMIT FEES AND CHARGES On all plumbing work requirering a plumbing permit, a fee for each plumbing permit shall be paid as required at the time of issue, in accordance with the following schedule: (1) Plumbing Permit Fee Schedule Standard Plumbing Code - Appendix B Permit Issuance 1. For issuing each permit $25.00 Unit Fee schedule (in addition to Item 1 or 2 above) 1. For each plumbing fixture or trap or set of fixtures on one trap (including water, drainage piping and backflow protection therefore) $2.50 2. For each building sewer and each trailer park sewer $2.50 3. For each water heater and / or vent $4.00 4. For each industrial waste pretreatment interceptor including its trap and vent, excepting kitchen-type grease interceptors functioning as fixture traps $20.00 5. On all mechanical systems requiring a mechanical permit, a fee for each mechanical permit shall be paid as required at the time of issue, in accordance with the following schedule:
Standard Mechanical Code, Appendix B Section B101 Permit Fees B101.1 Initial Fee For issuing each permit $10.00 B101.2 additional Fees B101.2.1 Fee for inspecting heating, ventilating, ductwork, air conditioning and refrigeration system shall valuation of the installation plus $2.00 for each additional $1,000.00 or fraction thereof. B101.2.2 Fee for inspecting repairs, alterations and additional to an existing system shall be $5.00 plus $2.00 for each $1,000.00 or fraction thereof. Section B102 Fee for Re-inspection In case it becomes necessary to make a re-inspection of a heating, ventilation, air conditioning or refrigeration system, or boiler installation, the installer of such equipment shall pay a re-inspection fee of $5.00.
When preliminary inspection is required for purposes of permitting temporary operation of a heating, ventilating, refrigeration, or air conditioning system, or portion thereof $5.00, shall be paid by the contractor requesting such temporary operation. If the system is not approved for temporary operation on the first preliminary inspection, the usual re-inspection fee shall be charged for each subsequent preliminary inspection for such purpose. Section B104 Self-Contained Units Less Than Two Tons In all buildings, except one and two family dwellings, where self-contained air conditioning units of less than two tons are to be installed, the fee charged shall be that for the total cost of all units combined (see B101.2.1 for rate) (2) Fee For Appeals Any person appealing a decision of the mechanical official shall pay a fee of fifty dollars ($50.00) to the City at the time such appeal is filed. SECTION 11 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TERRELL, TEXAS: THAT Appendix 1, Fee Schedule, SECTION 11, GAS WORK PERMIT FEES AND CHARGES: SUBSECTION 1 AND 2 of the Revised Code of Ordinances of the City of Terrell, Texas, shall be deleted in its entirety and read as follows: SECTION 11: GAS WORK PERMIT FEES AND CHARGES On all installations requiring a gas permit, a fee for each gas permit shall be paid as required at the time of issue, in accordance with the following schedule: (1) Permit Fee Schedule Section B101 For issuing each permit, a fee of $5.00 will be charged: SectionB102 The total fees for inspection of consumers' gas piping at one location (including both rough and final piping inspection) shall be $5.00 for one to four outlets, inclusive, and $1.00 for each additional outlet: Section B103 The fees for inspecting conversion burners, floor furnaces, incinerators, boilers, or central heating or a air conditioning unit shall be $5.00 for one unit and $1.00 for each additional unit: Section B104 The fee for inspecting vented wall furnaces and water heaters shall be $2.50 for one unit and $1.00 for each additional unit: Section B105 If a re-inspection is required, an additional fee of $5.00 will be charged: Section B106 If any person commences any work before obtaining the necessary permit and inspection, fee shall be doubled: and Section B107 Any and all fees shall be paid by the person to whom the permit is issued.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TERRELL, TEXAS: THAT Appendix 1, Fee Schedule, SECTION 30, ZONING FEES AND CHARGES of the Revised Code of Ordinances of the City of Terrell, Texas, shall be deleted in its entirety and read as follows: SECTION 30: ZONING FEES AND CHARGES Zoning Fees and Charges every person , partnership or corporation
desiring to obtain a specific use permit, a charge in the zoning
classification, or appeal thereon shall pay a fee at the time
of application or appeal to the City in accordance with the following
schedule:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TERRELL, TEXAS: THAT Appendix 1, Fee Schedule, SECTION 31, FOOD SERVICE PERMIT FEES AND CHARGES of the Revised Code of Ordinances of the City of Terrell, Texas, shall be amended by adding the following: SECTION 31: FOOD SERVICE PERMIT FEES For each temporary food service establishment $40.00 SECTION 32
Sign permit fees as regulated by Chapter 4, Section 22 of the Revised Code of Ordinance shall be paid to the City at time of issue in accordance with the following schedule: (1) Sign with areas: 0-60 sq. ft. $70.00
All ordinances or parts of ordinances in conflict herewith are,
to the extent of such conflict, hereby repealed. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this Ordinance are severable and, if any phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and section so this Ordinance, since the same would have been enacted by the city council without the incorporation of this ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. SECTION IV. This ordinance will take effect immediately from and after its passage and the publication of the caption, as the law in such cases provides. DISCUSS AND CONSIDER ADOPTION ON SECOND READING ORDINANCE NO. 2044 - AMENDING APPENDIX 1, FEE SCHEDULE, SECTION 26, WATER AND SEWER CONNECTION CHARGES OF THE REVISED CODE OF ORDINANCES OF THE CITY OF TERRELL ORDINANCE NO. 2044 AN ORDINANCE OF THE CITY OF TERRELL, TEXAS, AMENDING APPENDIX 1, FEE SCHEDULE, SECTION 26: WATER AND SEWER CONNECTION CHARGES OF THE REVISED CODE OF ORDINANCES OF THE CITY OF TERRELL, TEXAS; PROVIDING FOR REPEAL OF CONFLICTING ORDINANCES; PROVIDING FOR SEVERABILITY AND PROVIDING AN EFFECTIVE DATE. SECTION I. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TERRELL, TEXAS: THAT Appendix I, Fee Schedule, SECTION 26, WATER AND SEWER CONNECTION CHARGES of the Revised Code of Ordinances of the City of Terrell, Texas, shall be deleted in its entirety and read as follows: SECTION I. SECTION 26: WATER AND SEWER CONNECTION CHARGES The amounts to be charged and collected by the City for connection to the water mains and to the sanitary sewer system shall be as follows: (1) Water Meter Set: Size of Meter Amount of Charge 3/4 Inch $125.00 (2) Metered Water Service Connection Charges: Size of Connecting Line Amount of Charge (3) Non-metered Water Service Connection Charge: Quoted charge based on the city engineer's estimate of time and materials required for each individual service line. (4) Sanitary Sewer Service Connection Charges: Size of Connecting Line Amount of Charge (5) Boring Installations: When it is necessary to bore under any street or sidewalk for water or sewer main or service line installation of a size larger than 2", a charge shall be made for the actual cost of such installations. SECTION II. All ordinances or parts of ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. SECTION III. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this Ordinance are severable and, if any phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and section so this Ordinance, since the same would have been enacted by the city council without the incorporation of this ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. SECTION IV. This ordinance will take effect immediately from and after its passage and the publication of the caption, as the law in such cases provides. ARTICLE I. THAT, Chapter 9, Section A. Classification of Fire Fighters of the Revised Code of Ordinances of the City of Terrell, Texas, be and is hereby amended to read as follows: SECTION A. CLASSIFICATION OF FIRE FIGHTERS The position of Fire Inspector/Investigator is hereby deleted from the Classification of Fire Fighters of the City of Terrell Fire Department and Fire Marshal is added to the classification as follows, with the numbers of position and salary as stated adjacent to the classification. DISCUSS AND CONSIDER ADOPTION ON SECOND READING ORDINANCE NO. 2050 - BUDGET AMENDMENT ORDINANCE NO. 2050 AN ORDINANCE OF THE CITY OF TERRELL, TEXAS, AMENDING THE ANNUAL BUDGET FOR THE YEAR BEGINNING OCTOBER 1, 2000, AND ENDING SEPTEMBER 30, 2001, AS PASSED AND ADOPTED ON SEPTEMBER 5, 2000, TO PROVIDE FOR INCREASES AND DECREASES IN CERTAIN ACCOUNTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TERRELL, TEXAS: SECTION I. It is hereby declared to be the intention of the City Council that
the sections, paragraphs, sentences, clauses, and phrases of this
Ordinance are severable and, if any phrase, clause, sentence,
paragraph, or section of this Ordinance shall be declared unconstitutional
by the valid judgment or decree of any court of competent jurisdiction,
such unconstitutionally shall not affect any of the remaining
phrases, clauses, sentences, paragraphs, and sections of this
Ordinance, since the same would have been enacted by the city
council without the incorporation of this Ordinance of any such
unconstitutional phrase, clause, sentence, paragraph, or section.
This Ordinance will take effect immediately from and after its passage and the publication of the caption, as the law in such cases provides. PASSED AND APPROVED ON THIS 6th DAY OF FEBRUARY, 2001.
ORDINANCE NO. 2051 AN ORDINANCE AMENDING CHAPTER 2, ADMINISTRATION, SECTION 2 TERRELL MUNICIPAL AIRPORT BOARD, TERRELL CITY CODE, REVISED, PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TERRELL: ARTICLE I. That Chapter 2, Administration, Section 2, Terrell Municipal Airport Board, Paragraph A Composition and Appointment of Members be amended as follows: A. COMPOSITION AND APPOINTMENT OF MEMBERS The Terrell Municipal Airport Board shall consist of eight (8) members appointed by the city council. This board shall consist of members residing both in the City of Terrell and out of town residents. The city manager or his designee shall serve as an ex-officio member of the board. That Chapter 2, Section 2 of the Terrell City Code, as amended, shall remain in full force and effect, save and except as amended by this Ordinance. ARTICLE II.
