CITY COUNCIL MEETING MAY 12, 2000 5:30 P.M. A regular meeting of the Terrell City Council was held on Tuesday, May 2, 2000 in the City Council Chambers at 5:30 P.M. with the following members present: COUNCILMEMBER #1 HENRY C. MADGWICK 1. CALL TO ORDER Mayor Henry Madgwick called the meeting to order. 2. INVOCATION Mayor Henry Madgwick gave the opening prayer. 3. CONSIDER APPROVAL OF CITY COUNCIL REGULAR MEETING MINUTES OF APRIL 18, 2000 Mayor Pro tem James Huffman made a motion to approve the City Council Regular Meeting Minutes of April 18, 2000. The motion was seconded by Councilmember Lee Schaeffer. Ayes - Henry Madgwick, Frances Anderson, Lee Schaeffer, James Huffman; Nayes - none. Councilmember Tommy Spencer - no vote. Motion carried. NEW BUSINESS 4. PRESENTATION OF T.A.R.A.'S FINAL PLANS FOR STORAGE FACILITY IN BEN GILL PARK City Manager Gordon Pierce and Mark Smith, President of T.A.R.A. presented to Council for discussion and consideration Presentation of T.A.R.A's Final Plans for Storage Facility in Ben Gill Park. Councilmember Lee Schaeffer made a motion to approve T.A.R.A's Final Plans for Storage Facility in Ben Gill Park. The motion was seconded by Councilmember Frances Anderson. Ayes - all; Nayes - none. Motion carried.
Larry Freeman of Freeman-Millican presented to Council for discussion and consideration Award of Contract on West End Drainage Improvements, Project No. 99-05. Councilmember Frances Anderson made a motion to table this item. The motion was seconded by Councilmember Lee Schaeffer. Ayes - all; Nayes - none. Motion carried. 6. DISCUSS AND CONSIDER BID AND AWARD OF CONTRACT FOR VIDEO CAMERAS FOR PATROL UNITS City Manager Gordon Pierce and Joel Blair, Sergeant - Terrell Police Department presented to Council for discussion and consideration Bid and Award of Contract for Video Cameras for Patrol Units. Mayor Pro tem James Huffman made a motion to award bid for Video Cameras for Patrol Units to Kustom Signals in the amount of $18,746.00. The motion was seconded by Councilmember Frances Anderson. Ayes - all; Nayes - none. Motion carried. Councilmember Tommy Spencer commented he wants to see a demonstration of the video equipment. 7. DISCUSS AND CONSIDER PROPOSED REVENUES OF THE TOURISM FUND FOR FISCAL YEAR 2000-2001 City Manager Gordon Pierce presented to Council for discussion and consideration Proposed Revenues of the Tourism Fund for Fiscal Year 2000-2001. Councilmember Lee Schaeffer made a motion to approve Proposed Revenues of the Tourism Fund for Fiscal Year 2000-2001. The motion was seconded by Councilmember Tommy Spencer. Ayes - all; Nayes -none. Motion carried. 8. DISCUSS AND CONSIDER APPOINTMENTS TO PLANNING AND ZONING COMMISSION City Manager Gordon Pierce presented to Council for discussion and consideration Appointments to Planning and Zoning Commission. Councilmember Frances Anderson made a motion to re-appoint Ray Appleton, Rick Carmona and Harold Leigh to the Planning and Zoning Commission. The motion was seconded by Councilmember Lee Schaeffer. Ayes - all; Nayes -none. Motion carried. 9. DISCUSS AND CONSIDER APPOINTMENTS TO TERRELL PUBLIC LIBRARY BOARD City Manager Gordon Pierce presented to Council for discussion and consideration Appointments to Terrell Public Library Board. Mayor Pro tem James Huffman made a motion to table this item to May 16, 2000 Council meeting. The motion was seconded by Councilmember Lee Schaeffer. Ayes - all; Nayes - none. Motion carried. 10. HEAR REMARKS FROM VISITORS Art Hendon presented to Council T-shirts and caps. 11. DISCUSS AND CONSIDER APPROVAL OF ORDINANCE NO. 2018 - CANCELING THE MAY 6, 2000 REGULAR ELECTION AND DECLARING EACH UN-OPPOSED CANDIDATE ELECTED TO OFFICE City Manager Gordon Pierce presented to Council for discussion and consideration Approval of Ordinance No. 2018 - Canceling the May 6, 2000 Regular Election and Declaring Each Un-Opposed Candidate Elected to Office on second reading. Mayor Pro tem made a motion to approve Ordinance No. 2018 - Canceling the May 6, 2000 Regular Election and Declaring Each Un-Opposed Candidate Elected to Office on second reading. The motion was seconded by Councilmember Frances Anderson. Ayes - all; Nayes - none. Motion carried. ORDINANCE NO.2018 AN ORDINANCE OF THE CITY OF TERRELL, TEXAS CERTIFYING ALL CANDIDATES UNOPPOSED ON BALLOT OF REGULAR MUNICIPAL ELECTION FOR THE CITY OF TERRELL SET FOR SATURDAY, MAY 6, 2000; FOR ELECTION OF MAYOR AND COUNCIL MEMBERS IN DISTRICT NO. 2 AND DISTRICT NO. 4; DECLARING EACH UNOPPOSED CANDIDATE ELECTED TO OFFICE; AUTHORIZING COPY OF ORDINANCE POSTED ON ELECTION DATE AT EACH POLLING PLACE TO BE USED IN ELECTION; AND PROVIDING THAT IT SHALL BECOME EFFECTIVE FROM AND AFTER ITS PASSAGE AND ADOPTION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TERRELL, TEXAS: WHEREAS, On March 21, 2000, the City Council of the City of Terrell adopted Ordinance Number 2012 calling the regular municipal election for the City of Terrell, Texas, for the election of Mayor and Council Members from District No. 2 and District No. 4 with such election to be held on Saturday, May 6, 2000; and WHEREAS, each candidate whose name is to appear on the ballot is unopposed and there is no proposition appearing on the ballot; and WHEREAS, the City Secretary has certified in writing that all candidates are unopposed for election; WHEREAS, the filing deadlines for placement on the ballot and declaration of write-in candidacy has passed; and WHEREAS, in these circumstances Subchapter C of Chapter 2 of the Election Code authorizes a governing body to declare each unopposed candidate elected to office and cancel the election. NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TERRELL, TEXAS, THAT: SECTION I. The general election for the City of Terrell scheduled for Saturday, May 6, 2000, shall not be held in accordance with Section 2.051 of the Election Code and it is hereby declared that each unopposed candidate is hereby elected to the offices as follows: In District No. 2 In District No. 3 In District No. 4 In District No. 5 In District No. 2 In District No. 4 SECTION II. A copy of this Ordinance shall be posted on election day at each polling place that would have been used in the election and a Certificate of Election issued to each candidate. SECTION III. This ordinance shall be cumulative of all provisions of ordinances of the City of Terrell, Texas, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances, in which event the conflicting provisions of such ordinances are hereby repealed. SECTION IV. It is hereby declared to be the intention of the city council that the phrases, clauses, sentences, paragraphs, and sections of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgement or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the city council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. SECTION V. Passed and Approved on this the 18th day of April, 2000.
