CITY COUNCIL MEETING MAY 20, 1997 7:00 P.M. 1.0 ANNOUNCEMENTS & PUBLIC HEARINGS A regular meeting of the City Council was held in the City Council Chambers at City Hall, 201 East Nash Street, Terrell, Texas, at 7:00 p.m. with the following members present: COUNCILMEMBER #1 DON L. LINDSEY 1.1 INVOCATION Mayor Don L. Lindsey called the meeting to order, and Councilmember Tommy Spencer gave the opening prayer. 1.2 SPECIAL RECOGNITION AWARD - MARCH OF DIMES FUND-RAISER Councilmember Tommy Spencer and Councilmember Jack Jones presented a certificate of appreciation to Cindy Hunter and Raylan Baker, for their work during the March of Dimes fund-raiser. 1.3 PRESENTATION OF ARLIE WHITE P.R.I.D.E. AWARD Award recipient was not present, no action taken. 2.0 MINUTES 2.1 CONSIDER APPROVAL OF CITY COUNCIL MINUTES OF THE REGULAR MEETING HELD MAY 6, 1997 A motion was made by Councilmember Tommy Spencer and seconded by Councilmember James Huffman to approve minutes of regular meeting held May 6, 1997. Ayes all; Nayes none. Motion carried. 3.0 BIDS 3.1 CONSIDER BIDS AND AWARD OF CONTRACT FOR FLEXIBLE BASE The following bids were presented to Council for award of contract for Flexible Base from Public Works Director, Steve Rogers. A motion was made by Councilmember Jack Jones and seconded by Mayor ProTem Frances Anderson to award contract for Flexible Base to the low bid from Richard Crow & Son. Ayes all; Nayes none. Motion carried. BID TABULATION - FLEXIBLE BASE Company Name CITY COUNCIL MINUTES 4.0 ROUTINE BUSINESS 5.0 OLD BUSINESS 6.0 NEW BUSINESS 6.1 CONSIDER APPROVAL OF CHANGE ORDER NO. 1 FOR THE AIRPORT ROAD/INDUSTRIAL BLVD. PROJECT Councilmember James Huffman spoke against the change order. A motion was made by Councilmember James Huffman and seconded by Mayor ProTem Frances Anderson to table item 6.1 - Consider approval of change order no. 1 for the Airport Road/Industrial Blvd. Project. Ayes all; Nayes none. Motion carried. 6.2 CONSIDER APPROVAL OF TESTING/LAB SERVICES FOR AIRPORT ROAD/INDUSTRIAL BLVD. PROJECT A motion was made by Councilmember Jack Jones and seconded by Councilmember Tommy Spencer to table item 6.2 - Consider approval of testing/lab services for Airport Road/Industrial Blvd. Project. Ayes all; Nayes none. Motion carried. 6.3 CONSIDER APPROVAL OF RESALE OF THE FOLLOWING PROPERTIES: 1. NELSON ADDITION, LOT 1, BLOCK 3; 2. STALLINGS 3RD & 4TH, LOTS 1&2, BLOCK 22 A motion was made by Mayor ProTem Frances Anderson and seconded by Councilmember Tommy Spencer to approve of resale of the properties; Nelson Addition, lot 1, block 3 and Stallings 3rd & 4th, Lots 1&2, Block 22. Ayes all; Nayes none. Motion carried. 6.4 CONSIDER APPROVAL OF ORDINANCE NO. 1875 - AMENDING THE ANNUAL BUDGET A motion was made by Councilmember Jack Jones and seconded by Councilmember Tommy Spencer to approve on first reading Ordinance no. 1875 - amending the annual budget. Ayes all; Nayes none. Motion carried. ORDINANCE NO. 1875 AN ORDINANCE OF THE CITY OF TERRELL, TEXAS, AMENDING THE ANNUAL BUDGET FOR THE YEAR BEGINNING OCTOBER 1, 1996, AND ENDING SEPTEMBER 30, 1997, AS PASSED AND ADOPTED ON SEPTEMBER 17, 1996, TO PROVIDE FOR INCREASES AND DECREASES IN CERTAIN ACCOUNTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TERRELL, TEXAS:
SECTION I. The General Fund Budget be amended to reflect the following increases in the budget: EXPENDITURES AMENDED BUDGET SECTION II. All ordinances or parts of ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. SECTION III. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this Ordinance are severable and, if any phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionally shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this Ordinance, since the same would have been enacted by the city council without the incorporation of this Ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. SECTION IV. This Ordinance will take effect immediately from and after its passage and the publication of the caption, as the law in such cases provides. PASSED AND APPROVED ON THIS 20TH DAY OF MAY, 1997. PASSED AND ADOPTED ON THIS 3RD DAY OF JUNE, 1997.

6.5 CONSIDER APPROVAL OF NORTH CENTRAL TEXAS COUNCIL OF GOVERNMENTS VOTING REPRESENTATIVES A motion was made by Councilmember James Huffman and seconded by Mayor ProTem Frances Anderson to appoint Councilmember Tommy Spencer as North Central Texas Council of governments Voting Representative. Ayes all; Nayes none. Motion carried.
6.6 CONSIDER APPROVAL OF BOARD APPOINTMENTS TO THE PLANNING AND ZONING COMMISSION A motion was made by Councilmember James Huffman and seconded by Mayor ProTem Frances Anderson to replace Herschel McKinney with Herald Lee on the Planning and Zoning Commission, reappointing Rick Carmona and Ray Appleton. Ayes all; Nayes none. Motion carried. 6.7 CONSIDER APPROVAL OF AGREEMENT WITH RALPH ANDERSON & ASSOCIATES TO OBTAIN A CITY MANAGER A motion was made by Councilmember Jack Jones and seconded by Councilmember Tommy Spencer to approve the agreement with Ralph Anderson & Associates to obtain a City Manager. Ayes all; Nayes none. Motion carried. 6.8 CONSIDER APPROVAL OF RESOLUTION NO. 308 - MORATORIUM OF PORTABLE SIGNS Councilmember Jack Jones spoke against the Moratorium for Portable Signs. A motion was made by Councilmember James Huffman and seconded by Councilmember Tommy Spencer to approve Resolution No. 308 - Moratorium of Portable Signs. Ayes all; Nayes - Councilmember Jack Jones. Motion carried. 7.0 DISCUSSION ITEMS 8.0 EXECUTIVE SESSION 9.0 HEAR REMARKS FROM VISITORS 10.0 ADJOURNMENT There were no other matters discussed or acted on at this
meeting.
