1.0 ANNOUNCEMENTS & PUBLIC HEARINGS

A regular meeting of the City Council was held September 2, 1997, at 7:00 p.m., with the following members present:

1.1 INVOCATION

Don L. Lindsey called the meeting to order and Councilmember Jack Jones gave the opening prayer.

1.2 CONDUCT A PUBLIC HEARING FOR THE FISCAL YEAR 1997-98 BUDGET

Interim City Manager Linda Seabolt presented the budget for the 197-98 fiscal year to council. The budget includes 5% increase in employee salaries and a large sum of money for streets, water, and drainage. No one came forward to speak for or against the proposed budget. A motion was made by Councilmember James Huffman and seconded by Councilmember Jack Jones to close the public hearing. Ayes all; Nayes none. Motion carried.

1.3 PRESENTATION OF THE ARLIE WHITE P.R.I.D.E. AWARD

Councilmember James Huffman presented Fidencio Cabrera with the September Arlie White P.R.I.D.E. Award Certificate.

2.0 MINUTES

2.1 CONSIDER APPROVAL OF CITY COUNCIL MINUTES OF THE REGULAR MEETING HELD AUGUST 19, 1997

A motion was made by Councilmember James Huffman and seconded by Councilmember Tommy Spencer to approve the City Council Minutes of the regular City Council meeting held August 19, 1997. Ayes all; Nayes none. Motion carried.

Discussion - Councilmember Jack Jones discussed amount of time the contractor has after the award of bid to tear down a structure. Interim City Manager Linda Seabolt explained that the City expects the contractor to complete the work within 30 days. The time frame is part of the contract with the contractor. A motion was made by Councilmember Tommy Spencer and seconded by Councilmember Jack Jones to accept the low bidder of each structure.

3.2 CONSIDER BIDS AND AWARD OF CONTRACT FOR TRAILER MOUNTED BRUSH CHIPPER


A motion was made by Councilmember Jack Jones and seconded by Councilmember Tommy Spencer for a consent agenda; to table items 3.2 and 3.3. Ayes all; Nayes none. Motion carried.

3.3 CONSIDER BIDS AND AWARD OF CONTRACT FOR PAVEMENT PATCHING SYSTEM

CONSIDER ADOPTION OF ORDINANCE NO. 1884 - AMENDING CITY CODE OF ORDINANCE, APPENDIX 1, SECTION 20, DANCE AND GAME HALL PERMIT FEES

A motion was made by Councilmember Jack Jones and seconded by Councilmember Tommy Spencer to adopt on second reading, Ordinance No. 1884 - Amending City Code of Ordinance, Appendix 1, Section 20, Dance and Game Hall Permit Fees. Ayes all; Nayes none. Motion carried.

ORDINANCE NO. 1884

AN ORDINANCE AMENDING APPENDIX 1, FEE SCHEDULE, SECTION 20, OF THE CITY OF TERRELL CODE OF ORDINANCES, BY REVISING SECTION 20, AMENDING PERMIT FEES; AND PROVIDING FOR A SEVERABILITY CLAUSE AND EFFECTIVE DATE.


BE IT ORDAINED BY THE CITY COUNCIL OF CITY OF TERRELL, TEXAS:

Appendix 1, Fee Schedule, as set forth in the City of Terrell Code of Ordinances, is hereby amended by the revisions of Section 20, Dance and Game Halls Permit Fees as follows:

ARTICLE I

SECTION 20: DANCE AND GAME HALLS PERMIT FEES

(1) Initial Permit Fee

Any person who wishes to operate a pool hall, public dance hall, private club, or other place of amusement shall pay a permit fee of fifteen hundred dollars ($1,500.00). Such permit shall expire (12) months from the date of issuance.

(2) Permit Renewal Fee

On or before the expiration of the permit each year, such operator of a pool hall, public dance hall, private club, or other place of amusement holding a permit shall renew such permit in the same manner as the original permit and by paying an annual permit renewal fee of fifteen hundred dollars ($1,500.00).

6.1 ADMINISTER OATH OF OFFICE TO MUNICIPAL COURT JUDGE

City Attorney, Mary Gayle Ramsey, administered the Oath of Office of Municipal Court Judge to Court Judge Jerry Green.

6.2 CONSIDER APPROVAL OF ORDIANCE NO. 1886 - TRAFFIC SIGNAGE

A motion was made by Councilmember Jack Jones and seconded by Councilmember James Huffman to approve on first reading Ordinance No. 1886 - Traffic Signage. Ayes all; Nayes none. Motion carried.

ORDINANCE NO. 1886

AN ORDINANCE OF THE CITY OF TERRELL, TEXAS, AUTHORIZING THE INSTALLATION OR MODIFICATION AND MAINTENANCE OF REGULATORY TRAFFIC CONTROL SIGNAGE AT VARIOUS INTERSECTIONS WITHIN SAID JURISDICTION; PROVIDING FOR ENFORCEMENT; PROVIDING FOR THE REPEAL OF CONFLICTING ORDINANCES; PROVIDING FOR PUBLICATION; AND ESTABLISHING AN EFFECTIVE DATE.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TERRELL, TEXAS:

ARTICLE I.

THAT in accordance with Chapter 11, Section 35, of the 1986 Revised Code of Ordinances, and following engineering investigation, the installation of YIELD signs conforming to the following schedule is hereby authorized and directed:

ARTICLE II.

THAT the YIELD sign assigns right-of-way to traffic on certain approaches to an intersection, and drivers or operators of vehicles approaching such signs shall stop when necessary to avoid interference with other traffic that is given the right-of-way.

ARTICLE III.

THAT all ordinances or parts of ordinances in conflict herewith are, to the extent of such conflict, hereby repealed.

ARTICLE IV.

This Ordinance shall take effect immediately from and after its passage and the publication of the caption as the law in such cases provides.

6.3 CONSIDER APPROVAL OF PARK BOARD RECOMMENDATIONS

A motion was made by Councilmember Jack Jones and seconded by Councilmember Tommy Spencer to table item 6.3, consider approval of Park Board recommendations. Ayes all; Nayes none. Motion carried.

6.4 CONSIDER APPROVAL OF ORDINANCE NO. 1888 - TAX RATE OF ALL TAXABLE PROPERTY WITHIN THE CITY OF TERRELL

A motion was made by Councilmember James Huffman and seconded by Councilmember Tommy Spencer to approve on first reading, Ordinance No. 1888 - Tax Rate of all Taxable Property within the City of Terrell. Ayes all; Nayes none. Motion carried.

6.5 CONSIDER APPROVAL OF ORDINANCE NO. 1889 - ADOPTING FISCAL YEAR 1997-98 BUDGET, EFFECTIVE OCTOBER 1, 1997.

A motion was made by Councilmember Tommy Spencer and seconded by Councilmember Jack Jones to approve on first reading Ordinance No. 1889 - Adopting Fiscal Year 1997-98 Budget, Effective October 1, 1997. Ayes all; Nayes none. Motion carried.

ORDINANCE NO. 1889

AN ORDINANCE OF THE CITY OF TERRELL, TEXAS, ADOPTING THE 1997-98 BUDGET FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 1997, FOR THE CITY OF TERRELL, TEXAS.

WHEREAS, pursuant to the laws of the State of Texas and Article V, Section 5.02 of the City Charter of the City of Terrell, the City Manager of Terrell prepared his budget covering proposed expenditures for the fiscal year 1997-198 and caused Notice of Hearing on same to be published as required by law; and

WHEREAS, a public hearing was held by the City Council of the City of Terrell, Texas, on said proposed budget on September 2, 1997, at which time and budget was fully considered, and interested taxpayers were heard by said City Council, which said proposed budget with changes has been marked "Exhibit A" and made a part hereof, is hereby approved as the Official Budget covering the City of Terrell's operation for and during the fiscal year beginning October 1, 1997, and ending September 30, 1998, said expenditures by said City for and during such time shall be on the basis of said budget.

No expenditures not provided for in said budget shall be made unless the same be in the nature of emergencies and after which emergencies have been declared by the said City Council of the City of Terrell.

This ordinance adopting the budget for the ensuing fiscal year is subject to such application as the President's Executive Order on Stabilization may have on it which order was based on the authority vested in the President by the Constitution and Statues of the United States, including the Economic Stabilization Act 1970 (P.L. 91-379 Stat. 799) as amended.

THAT this ordinance shall take effect and be in force from and after its passage and adoption.
