NO. 1939
AN ORDINANCE AMENDING CHAPTER 5, SECTION 2; SUBSECTION
C; OF THE CITY OF TERRELL CODE OF ORDINANCES; REGULATING THE SALE OF ALCOHOLIC
BEVERAGES NEAR CHURCHES, PUBLIC HOSPITALS, PUBLIC SCHOOLS, OR OTHER EDUCATIONAL
INSTITUTIONS PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TERRELL:
ARTICLE I.
That Chapter 5, Section 2, Subsection C, SALE OF ALCOHOLIC
BEVERAGES NEAR CHURCHES,PUBLIC HOSPITALS, PUBLIC SCHOOLS OR OTHEREDUCATIONAL
INSTITITIONS shall be amended to comply with current law:
Chapter 5, Section 2, Subsection C shall hereafter read
as:
C. Sale of Alcoholic Beverages Near Churches. Public Hospitals.
Public Schools or Other Educational Institutions.
It shall be unlawful for any person to sell or engage in
the business of selling alcoholic beverages within the City where the
place of business is within 300 feet of any church, public hospital or
within 1,000 feet of public schools or other educational institution.
The measurement of the distance between the place of business where alcoholic
beverages are sold and the church or public hospital shall be along the
property lines of the street fronts and from front door to front door,
and in direct line across intersections. The measurement of the distance
between the place of business where alcoholic beverages are sold and the
public schools shall be in a direct line from the property line of the
public school to the property line of the place of business, and in a
direct line across intersections.
That Chapter 5, Section 2, Subsection C of the City of Terrell
Code of Ordinances shall remain in full force and effect, save and except
as amended by this Ordinance.
ARTICLE II.
That the terms and provisions of this ordinance are severable
and are governed by all applicable Sections of the City of Terrell Code
of Ordinances, as amended.
ARTICLE III.
That this ordinance shall take effect immediately from and
after its passage and publication in accordance with the provisions of
the Charter of the City of Terrell, and it is accordingly so ordained.
